Effective Date: April 16, 2026
These Terms and Conditions ("Terms") govern all landscaping, lawn care, hardscaping, snow removal, and related services ("Services") provided by Wells Landscaping ("Company", "we", "us", or "our") to the customer ("Client", "you", or "your"). By scheduling or accepting Services, you agree to these Terms.
Scope of Services
Wells Landscaping agrees to provide Services as described in the written estimate, proposal, invoice, or service agreement approved by the Client. Any services not expressly listed are excluded unless agreed to in writing.
Estimates & Pricing
- All estimates are based on visible conditions at the time of inspection.
- Prices may change if site conditions differ, additional services are requested, or material costs increase.
- Estimates are valid for 30 days unless otherwise stated.
Payment Terms
- Payment is due upon completion of services unless otherwise specified in writing.
- Ongoing or recurring services may be billed weekly or monthly.
- Late payments may be subject to a late fee of 10% per month.
- Wells Landscaping reserves the right to suspend services for non‑payment.
Cancellations & Scheduling
- Clients must provide at least 24 hours' notice to cancel or reschedule services.
- Late cancellations or no‑shows may incur a cancellation fee.
- Weather, equipment failure, or unsafe conditions may require rescheduling at our discretion.
Client Responsibilities
The Client agrees to:
- Clearly mark sprinkler heads, underground utilities, invisible fencing, and property boundaries.
- Remove pet waste, toys, yard décor, and other obstacles before service.
- Secure pets indoors during scheduled service times.
Wells Landscaping is not responsible for damage to unmarked or concealed items.
Property Conditions & Risk
- Landscaping work involves inherent risks, including minor damage to turf, plants, or hardscape.
- We are not responsible for pre‑existing damage, soil conditions, pest infestations, drainage issues, or plant failure caused by factors beyond our control (weather, disease, improper watering, etc.).
Plant & Material Warranty
- Plant material is not guaranteed unless explicitly stated in writing.
- Replacement of plant material, if offered, does not include labor unless specified.
Damage & Liability
- Any damage claims must be reported within 48 hours of service completion.
- Our liability is limited to the cost of the services provided.
- Wells Landscaping is not liable for indirect, incidental, or consequential damage.
Access & Right of Entry
The Client grants Wells Landscaping permission to enter the property to perform agreed Services during normal business hours or scheduled times.
Termination
Either party may terminate services with written notice. The Client is responsible for payment for all services performed up to the termination date.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Wisconsin.
Amendments
Wells Landscaping reserves the right to update these Terms at any time. Updated Terms will apply to future services.
Acceptance
By approving an estimate, scheduling services, or allowing work to begin, the Client acknowledges and agrees to these Terms & Conditions.
